Abstract

This commentary examines inequalities within India’s judicial system through the contrasting experiences of individuals facing prosecution under stringent security laws. Using the Supreme Court’s July 2023 decision granting bail to Bhima Koregaon accused Vernon Gonsalves and Arun Ferreira as a focal point, it discusses judicial interpretation of the Unlawful Activities (Prevention) Act (UAPA), access to bail and the unequal experience of justice. The article questions whether constitutional and judicial remedies are equally accessible to all sections of society.
