Abstract
This commentary examines whether India’s basic structure doctrine can serve as a constitutional safeguard against the global rise of populism and majoritarian governments. It explores the tension between judicial review and elected political authority and traces how the doctrine has influenced constitutional debates beyond India. The article considers its potential to protect constitutional principles, democratic institutions and limits on governmental power during periods of democratic crisis.
