Abstract

This article examines the continued use of preventive detention in India and its implications for civil liberties and constitutional freedoms. Drawing on the history of preventive detention and judicial responses to executive coercion, it critiques the Indian judiciary’s handling of detention measures used to restrict free speech and dissent. The article argues that the persistence and justification of preventive detention reveal a continuing tension between state power, individual liberty and the transformative constitutional vision of India.
