Abstract

This commentary examines the relationship between free speech, state power and judicial autonomy in India. It discusses the constitutional foundations of fundamental rights, rule of law and separation of powers, highlighting the judiciary’s role in protecting these principles within India’s democratic framework. The article considers how judicial autonomy can help reconcile the exercise of strong state authority with the protection of constitutional freedoms, particularly freedom of expression.
