Abstract

This article examines the legal and constitutional debate surrounding the criminalisation of marital rape in India. It critiques the marital rape exception under Section 375 of the Indian Penal Code for undermining women’s bodily autonomy, dignity and freedom of choice. The article argues that a horizontal approach to constitutional rights, attentive to gender and social hierarchies, offers a stronger framework for addressing consent and safeguarding women’s rights within marriage.
