Abstract

This commentary examines the relationship between majoritarian social impulses, state power and the erosion of liberal democratic principles in India. Using the state’s response to social media influencer Ranveer Allahbadia and the Chhattisgarh High Court’s decision concerning marital rape, it explores how changing understandings of obscenity, morality, criminality and individual rights are shaped by dominant social and political values. The article raises concerns about the implications of such developments for freedom of expression, gender justice and constitutionalism.
