Abstract

Section 12(1)(c) of the Right of Children to Free and Compulsory Education Act, 2009 mandates that unaided private schools set aside at least 25 per cent of entry-level seats for children from ‘economically weaker sections’ and ‘socially disadvantaged groups in the neighbourhood’. The precursor to this Act was Article 21A of the Constitution, introduced by the 86th Constitutional Amendment, which mandates the provision of free and compulsory education to all children between the ages of 6 and 14. Section 12(1)(c) specifically brings private unaided schools within a rights-based framework. The mandate is motivated by the argument that educating underprivileged children is ‘not merely the responsibility of schools run or supported by the appropriate governments, but also of schools which are not dependent on government funds’.
